{"id":4131,"date":"2021-06-26T18:33:39","date_gmt":"2021-06-26T17:33:39","guid":{"rendered":"https:\/\/www.bgcentar.org.rs\/?p=4131"},"modified":"2021-09-20T18:35:05","modified_gmt":"2021-09-20T17:35:05","slug":"press-release-on-international-day-in-support-of-victims-of-torture","status":"publish","type":"post","link":"https:\/\/www.bgcentar.org.rs\/en\/press-release-on-international-day-in-support-of-victims-of-torture\/","title":{"rendered":"Press Release on International Day in Support of Victims of Torture"},"content":{"rendered":"<p style=\"text-align: justify;\">On 26 June, International Day in Support of Victims of Torture, the Belgrade Centre of\u00a0Human Rights alerts the public to the fact that offences of torture and other forms of ill-treatment in Serbia still go largely unpunished, that the few perpetrators actually found guilty\u00a0of these crimes \u2013 are handed down extremely lenient sentences, usually conditional prison\u00a0sentences, while the courts regularly neglect the victims\u2019 right to redress and refer them to\u00a0file damage claims, resulting in their revictimisation and additional expenses. The realisation\u00a0of the victims\u2019 rights, especially to redress, is further undermined by the discontinuation of\u00a0criminal prosecution for such offences due to the expiry of the statute of limitations. The\u00a0victims are again merely left with the possibility of launching civil proceedings to prove they\u00a0had suffered \u201ccivil law damages\u201d, while the criminal liability of their torturers and abusers\u00a0can no longer be ascertained.<\/p>\n<p style=\"text-align: justify;\">The numerous cases of police brutality during the July 2020 protests illustrate the impunity of\u00a0public officials for torture and other forms of ill-treatment. None of the implicated officers\u00a0have been punished for their brutality during the protests; only a few, those who participated\u00a0in the incident in Novi Sad, have been identified. The Belgrade Public Prosecution Office\u00a0took the statements of most victims only in the spring of 2021. The only procedure in which\u00a0the police were found guilty of ill-treatment and violating civil rights was the one concerning\u00a0eight cases that was conducted by the Protector of Citizens, who, however, missed the\u00a0opportunity to require of the state to afford redress to the victims of police abuse without\u00a0delay.<\/p>\n<p style=\"text-align: justify;\">The BCHR also draws attention to this year\u2019s messages of UN experts, that torture victims\u00a0are entitled to rehabilitation and that individuals, experts and civil society organisations\u00a0assisting them in the process have the right to carry out their work unfettered of restrictions\u00a0and reprisals. The UN human rights experts expressed concern that torture survivors\u00a0continued to face challenges in accessing redress and reparations, including the fullest\u00a0rehabilitation possible.\u00a0They urged States to \u201cenable a conducive environment for redress and\u00a0rehabilitation for victims of torture, and for civil society to operate freely.\u201d<\/p>\n<p style=\"text-align: justify;\">In their\u00a0<a href=\"https:\/\/www.ohchr.org\/EN\/NewsEvents\/Pages\/DisplayNews.aspx?NewsID=27199&amp;amp;LangID=E\" target=\"_blank\" rel=\"noopener\">joint statement<\/a>, UN human rights experts said that the trend of reprisals, through\u00a0restrictive and retaliatory measures against civil society and torture survivors seeking redress\u00a0through the UN mechanisms remained prevalent and that impunity was widespread across the\u00a0world. \u201cGovernments continue to systematically deny the existence of such abhorrent\u00a0practices, refuse to prosecute perpetrators and use intimidation and reprisals against civil\u00a0society organizations, human rights defenders, whistleblowers and journalists in order to\u00a0deter them from speaking out and obtaining redress for victims.\u201d<\/p>\n<p style=\"text-align: justify;\">The BCHR has for over a decade now been analysing court and prosecutorial cases\u00a0concerning torture and ill-treatment at the hands of public officials.
