On the occasion International Day of Support to Victims of Torture marked on 26 June, the Belgrade Centre for Human Rights and International Aid Network (IAN) alert to the necessity of addressing the problems and consequences arising in societies not punishing perpetrators of torture or helping victims exercise their rights, as well as to the recommendations issued to Serbia within the most recent Universal Periodic Review (UPR)<\/a>\u00a0and the recommendations issued earlier by the European Committee for the Prevention of Torture and Inhuman or Degrading Treatment or Punishment (CPT)<\/a>.<\/p>\n

The State has made hardly any headway in the prevention of and fight against torture, although it is listed among Serbia\u2019s EU accession process goals and in many of its strategic documents. The expiry of the statute of limitations for such crimes, in contravention of Serbia\u2019s obligations under international law, is a blatant example of the State\u2019s lack of interest in combatting torture. Furthermore, the definition of torture in Serbia\u2019s Criminal Code is still not aligned with the one in Article 1 of the UN Convention against Torture and Other Cruel, Inhuman or Degrading Treatment or Punishment, although international bodies have been reiterating such a recommendation to Serbia for 10 years now.<\/p>\n

The CPT\u2019s ad hoc visit to Serbia in March 2023 illustrates concerns about Serbia\u2019s track record in suppressing torture. The Committee explained that it considered that the action taken to prevent ill-treatment by the police in light of the recommendations contained in the reports on the 2017 and 2021 visits was not sufficient, adding that its delegation also reviewed the effectiveness of investigations by the prosecutorial authorities and the Ministry of Internal Affairs (MIA) Internal Control Service into complaints of ill-treatment of detained persons by police officers.<\/p>\n

The Centre\u2019s data on prosecutorial and court cases concerning extortions of confessions and torture and ill-treatment by public officials from mid 2021 to end 2022 show that the practice of questioning suspects in the offices of crime inspectors in the absence of video and audio surveillance is still widespread in Serbia and that the domestic judicial authorities still by and large fail to order forensic medical examinations of victims and their injuries, while the medical examinations of the victims still suffer from substantial deficiencies. With a view to changing this practice, the Centre\u2019s representatives, who took part in consultations with the MIA Working Group charged with drafting the new law on internal affairs, advocated that the new law prescribe audio and video recording of all interviews with members of the public and\/or suspects in police stations, which should be held only in dedicated interview rooms. The MIA Working Group dismissed this recommendation, as well as many others aimed at combatting ill-treatment (e.g. mandatory suspension of public officials suspected of ill-treatment and the dismissal of those found guilty of the crime, notification of all individuals summoned to the police of their rights, etc.), under the pretext that \u201cSerbia does not need to be the only country in Europe to comply with all CPT standards.\u201c<\/p>\n

The European Court of Human Rights has repeatedly held that public officials suspected of intentional ill-treatment must be suspended immediately and dismissed as soon as they are found guilty. However, numerous cases against police officers for using illegal and\/or excessive force against citizens are still pending before the Serbian prosecutors or have been inadequately sanctioned by the courts. For instance, nearly all cases of police ill-treatment during the July 2020 civic protests are still \u201ckept in the drawers\u201c of the prosecutors and the MIA Internal Control Sector, who are waiting for the expiry of the statute of limitations.<\/p>\n

The recent incidents during which Serbian police officers physically ill-treated migrants at the Mali Zvornik border crossing and the Sombor Reception Centre in April demonstrate that the practice of police violence is still tolerated and not punished in our society.<\/p>\n

To recall, as a signatory of the Convention against Torture, Serbia is under the obligation to provide torture victims with redress and fair compensation, including the right to comprehensive (psychological, medical, legal and social), available and adequate rehabilitation.<\/p>\n

Rather than merely paying lip service to the eradication of torture, the State must take action and address the deeply rooted problems inflicting harm on the citizens and the state on a daily basis. The institutions must prioritise the protection of torture victims, rather than protect state officials whose wrongdoings have been undermining public trust and grossly violating the citizens\u2019 fundamental human rights.<\/p>\n","protected":false},"excerpt":{"rendered":"
