A group of civil society organisations hereby draws the public\u2019s attention to the fact that a public debate on the Draft Law on Amendments to the Law on the Protection of Persons with Mental Health Difficulties ended on 9 August 2023. The Draft, prepared by the Ministry of Health of the Republic of Serbia, lay down the conditions for the compulsory confinement of children under the minimum age of criminal responsibility (MACR) who have committed crimes warranting minimum 10 years\u2019 imprisonment in a special ward of a psychiatric institution. Although it is extremely important to regulate by law the status of children too young to be held responsible for the crimes they committed, we are of the opinion that the Draft totally disregards the numerous aspects of the realisation of child rights and may result in the dehumanisation and ostracism from society of these children, whilst not improving community safety, which requires prevention programmes, improved early identification of at risk children and their referral to adequate intervention.<\/p>\n

In the view of the signatories of this press release, the Draft is incompatible with the Serbian Constitution and ratified international human rights treaties, above all the Convention on the Rights of the Child, the Convention on the Rights of Persons with Disabilities and the Convention against Torture and Other Cruel, Inhuman or Degrading Treatment or Punishment.<\/p>\n

Rather than fulfilling their primary purpose of improving the protection of persons with mental health difficulties, the Draft exacerbates the discrimination against and stigmatisation of persons with mental health difficulties, directly linking such issues with the commission of grave crimes, a view for which there is no empirical evidence.<\/p>\n

Under the Draft, decisions on the compulsory confinement of children under MACR for committing a crime warranting at least 10 years\u2019 imprisonment shall not be limited in time and the court shall be under the obligation to review the fulfilment of the requirements for extending their compulsory confinement and treatment every six months. These provisions diverge from the valid regime of the compulsory confinement of older persons (adults) under the Law on the Protection of Persons with Mental Health Difficulties, which sets out that the court may order the compulsory confinement of adults lasting one, three or six months. There are no reasonable grounds or justification, either medical i.e. psychiatric, or legal, for the divergence. Children under 14 kept in psychiatric institutions are thus placed at an obvious disadvantage vis-\u00e0-vis other patients in these institutions that \u2013 in addition to their discrimination \u2013 also opens the issue of the character of this measure, which acquires a punitive dimension.<\/p>\n

The Draft provides no safeguards against arbitrary deprivation of liberty although the procedure at issue ends in a decision on the deprivation of liberty of a child. Like the Law on the Protection of Persons with Mental Health Difficulties, the Draft does not provide for mandatory professional (legal) representation of the child in the compulsory confinement procedure.<\/p>\n

The impression that the Draft boils down to sheer repression as they provide for unlimited compulsory confinement of criminally irresponsible children in a psychiatric institution and their ostracism from the community is corroborated also by the Draft provisions providing for a temporary ban on visits and contacts with the child in the special ward of the psychiatric institution for security reasons \u2013 without any statutory limitation of the duration of such a \u201ctemporary\u201d ban. What is even more absurd is that the ban shall also apply to the child\u2019s immediate family and be in force in a high security facility, wherefore the regime of holding children in this part of the psychiatric institution may become inhuman and degrading.<\/p>\n

Research has consistently shown that social support is a protective factor in maintaining mental health and rehabilitation. The Draft allowing for depriving a child of social contacts and their isolation from their family and relatives for security reasons does not contribute to their recovery, resocialisation or rehabilitation; rather, it will in all likelihood impinge on their mental health and further development of their personal and social capacities.<\/p>\n

The Draft raises another question: Which procedure will be applied to determine whether or not the child to be subject to the restrictive regime prescribed by the Draft actually committed the grave crime warranting minimum 10 years\u2019 imprisonment given that criminal proceedings establishing whether the defendant committed a crime cannot be conducted against children under 14?<\/p>\n

All in all, the regime envisaged by the Draft for children below MACR who have committed grave crimes and have for this reason and because of \u201cthe manifested mental disorders\u201d been confined in the designated psychiatric institutions is substantially \u2013 and unjustifiably \u2013 more restrictive than the regime applicable to older children held criminally responsible for their actions.<\/p>\n

The signatory CSOs requested of the Ministry of Health to review the Draft in light of the objections and comments and extend, that is, reopen the public debate on it. The public debate should provide a forum for an active dialogue of all the relevant stakeholders, including experts on child rights, mental health and social protection professionals and CSOs focusing on the protection of human rights.<\/p>\n

The signatories of this press release will familiarise international supervisory bodies, notably, the Committee on the Rights of the Child and the Committee on the Rights of Persons with Disabilities, as well as the relevant UN special rapporteurs on human rights, with the content of the Draft and ask them to comment on it.<\/p>\n
