They facilitate the refugees\u2019 and asylum seekers\u2019 access to the right to work in the Republic of Serbia. Under the amendments, foreign nationals are entitled to simultaneously pursue their right to temporary residence and their right to access the labour market in a single procedure before one state authority (the Ministry of the Interior). Applications for the combined residence\/work permits are to be submitted electronically and the administrative procedure for employing foreigners is to be completed in a fortnight rather than two months.<\/p>\n<p style=\"text-align: justify;\">The online application for the residence permit on the e-Government (<em>e-Uprava<\/em>) portal was activated on 10 February but employers were unable to pay the required fee and thus apply for a single residence\/work permit on behalf of their foreign workers. The competent institutions have not commented the issue or offered an alternative solution. Furthermore, they still have not issued any additional instructions or guidelines on so-called open access to the labour market (for which no work or combined permit is required) for specific categories of foreigners, which was introduced by the amendments.<\/p>\n<p style=\"text-align: justify;\">As of 1 February, individuals granted asylum or subsidiary protection in Serbia no longer need to apply for work permits, pay the high fees and go through the complicated administrative procedures. They now have so-called open access to the labour market, like in the EU. Furthermore, asylum seekers are now entitled to access the labour market six months after they apply for asylum (rather than nine months, like in the past), which they prove by submitting a certificate that they applied for asylum (which is issued by the Serbian MOI Asylum Office), another step bringing Serbia closer to EU\u2019s practice.<\/p>\n<p style=\"text-align: justify;\">Under the amendments, foreigners granted temporary protection in Serbia on humanitarian grounds (victims of human trafficking or gender-based violence, et al) are also entitled access to the labour market, which the BCHR has been advocating for years. Open access to the labour market for this and other categories of foreigners (who do not need a single permit)<a href=\"#_ftn1\" name=\"_ftnref1\"><sup>[1]<\/sup><\/a> entitles them to exercise the right to work from the day they are granted asylum, subsidiary or temporary protection or residence on humanitarian grounds for the duration of their residence permits.<\/p>\n<p style=\"text-align: justify;\">The Serbian parliament adopted amendments to the Law on Foreigners in July 2023 as well. The new Article 68a of this law entitles asylees, who have been living in the Republic of Serbia for three years without interruption, to apply for permanent residence. The criteria applicable to refugees and introduced by this amendment are milder than those for other categories of foreigners, which are set out in Article 70 of the law, which the BCHR lobbied for during the public debates given the specific and personal circumstances of the asylees and their families. Furthermore, under the amendments, foreigners granted permanent residence are entitled to IDs for foreigners. The legal possibility provided refugees to obtain permanent residence is a major step forward in Serbia\u2019s asylum system.<\/p>\n<p style=\"text-align: justify;\">The BCHR calls on the business community in Serbia to familiarise itself with the new provisions of the Law on the Employment of Foreigners and the Law on Foreigners, and on the relevant authorities and institutions to provide all the necessary information transparently and launch all the services envisaged by the amendments to facilitate the durable integration of refugees in Serbia.<\/p>\n<p style=\"text-align: justify;\"><a href=\"#_ftnref1\" name=\"_ftn1\">[1]<\/a> Pursuant to Article 3 of the Law on the Employment of Foreigners (Official Gazette of the RS, Nos. 128\/2014, 113\/2017, 50\/2018, 31\/2019 and 62\/2023).<\/p>\n","protected":false},"excerpt":{"rendered":"<p>The new provisions of the Law on Employment of Foreigners, which the National Assembly adopted on 26 July 2023, entered into force on 1 February 2024.
