Civil society organizations have submitted an urgent appeal to the United Nations concerning proposed amendments to key judicial laws in Serbia. The appeal was submitted by the Centre for Judicial Research (CEPRIS), the Belgrade Centre for Human Rights, CRTA, FemPlatz, the Initiative for Economic and Social Rights \u2013 A11, the Lawyers\u2019 Committee for Human Rights (YUCOM), Civic Initiatives, and the informal group of judges and prosecutors \u201cDefence of the Profession\u201d<\/em> (Odbrana struke<\/em>). The appeal was addressed to the United Nations Special Rapporteur on the independence of judges and lawyers, due to serious threats to judicial independence in Serbia.<\/p>\n

The appeal concerns attempts to adopt five draft judicial laws<\/strong>[1], submitted on 22 December 2025 under an urgent legislative procedure by Member of Parliament Uglje\u0161a Mrdi\u0107, which are currently being debated by the National Assembly of Serbia at an extraordinary session that began on 14 January 2026<\/strong>. These draft laws were introduced without the prior publication of draft texts, without public consultation, and without consultations with judicial institutions, thereby circumventing fundamental democratic standards and professional safeguards. Moreover, the proposed amendments are marked by a clear absence of professional consensus.<\/p>\n

The signatory civil society organizations warn that the proposed amendments significantly strengthen political and executive influence over judges and prosecutors, in direct contradiction to the Constitution of Serbia and relevant international standards<\/strong>. Among the most problematic provisions identified are: the abolition of the High Prosecutorial Council commission responsible for deciding on objections to mandatory prosecutorial instructions; the introduction of ministerial consent or approval for certain prosecutorial actions; the transfer of authority to appoint the Special Prosecutor for High-Tech Crime; the possibility of reappointing court presidents for additional terms; the extension of mandates for acting chief public prosecutors; and the establishment of a special basic court and basic public prosecutor\u2019s office in Belgrade, which could be used to handle politically sensitive cases, including those related to EXPO 2027. These amendments effectively undermine the constitutional reforms adopted in 2022 within the framework of the EU accession process, which were expressly aimed at reducing political influence over the judiciary.<\/p>\n

The organizations requested that the UN Special Rapporteur examine the compatibility of these legislative proposals with international standards and urgently engage with the Serbian authorities, calling for the suspension of the urgent legislative procedure and the opening of an inclusive and transparent public debate.<\/p>\n

In parallel with this addressing to international mechanisms, the Working Group of the National Convention on the European Union for Chapter 23<\/strong> also issued a public response, warning that amendments to systemic judicial legislation are being adopted through urgent procedures in order to bypass the professional community and diminish the level of achieved rights and procedural guarantees. The Working Group particularly emphasized that such practices undermine the role of institutions established to safeguard judicial independence and noted that similar practices have already been repeatedly criticized by the European Commission.<\/p>\n
